These Terms of Service ("Terms") govern your use of TourCast, a live audio streaming service operated at tourcast.cowdrey.page ("Service"). By accessing or using the Service you agree to these Terms.
TourCast provides a real-time audio broadcasting tool intended for tour guides and similar use cases. A broadcaster streams live microphone audio to a group of listeners who join via a QR code or link. The Service is currently in early access and provided on an as-is basis.
You must be at least 13 years old to use the Service. By using the Service you represent that you meet this requirement.
As a broadcaster you are solely responsible for all audio content you transmit. You must not use the Service to broadcast:
We reserve the right to terminate or suspend access to the Service immediately, without prior notice, for any broadcaster who violates these Terms or whose broadcasts we reasonably determine to be harmful, abusive, or illegal. Because broadcasts are ephemeral and not stored, termination takes effect by ending the active session and blocking future access.
You retain ownership of any audio content you broadcast. By using the Service you confirm you have the right to broadcast that content. We do not record or claim any rights to your audio.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED ZAR 100.
You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
We may modify or discontinue the Service at any time without notice. We may update these Terms; the "Last updated" date above will reflect any changes. Continued use after an update constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
